All source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, product claims, and descriptions (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”), are owned or controlled by us or are licensed to us. These elements are protected by copyright and trademark laws, as well as various other intellectual property rights, including unfair competition laws, in the United States, international copyright laws, and international conventions. All product claims and descriptions presented on the Site are considered part of the proprietary content for the product’s website marketing and are protected as such. If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Utah (UT), and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms of Use. In no event shall any Dispute brought by either Party related in any way to the Site be commenced more than one (1) year after the cause of action arose.
